Stand-Alone Artificial Intelligence

  1. Stand-Alone AI Features. 3Play Media may make available certain features or services that allow Customers to use technologies such as artificial intelligence and machine learning without the participation of an Accessibility Services Professional (collectively, “Stand-Alone AI Features”). Stand-Alone AI Features include, by way of example, ASR and Machine Translation (when not combined with a human-in-the-loop) and Summarization.  Output generated by the Stand-Alone AI Features based on Customer’s Source Materials is referred to as “Output.”  Outputs are “Deliverables,” as defined in the Agreement. 
  2. Evaluation of Outputs. As with all artificial intelligence: (i) Outputs may be the same or similar to outputs generated for other users; (ii) Outputs may be inaccurate, infringing, or otherwise unsuitable to Customer’s use.  Customers should, and are solely responsible for, evaluating Outputs for accuracy, general suitability, compliance with laws and third party rights, and compliance with required AI-related notices.  
  3. Ownership. As between the parties, Customer owns the Outputs.  However, Customer acknowledges that, due to the nature of AI-produced content, it may not be able to claim or enforce intellectual property rights in or to the Outputs. 
  4. Disclaimers; Assumption of Risk. In addition to the disclaimers set forth in the Agreement, Outputs are provided “as-is” and without warranty.  Customer assumes all risk associated with its use of the Stand-Alone AI Features and the resulting Outputs; 3Play Media has no liability for any such use.  Outputs are provided without any representation or warranty as to accuracy, non-infringement, or compliance with Accessibility Standards. 

Eleven Labs

  1. ElevenLabs Voices.  Some 3Play Media services, such as AI Dubbing and Audio Description, use an ElevenLabs voice API.  By interacting with 3Play Media for these services, you are subject to the terms and conditions of the ElevenLabs platform and the ElevenLabs Privacy Policy.  
  2. Disclaimers; Assumption of Risk. In addition to the disclaimers set forth in the Agreement, ElevenLabs voices are provided “as-is” and without warranty.  3Play Media’s liability for damages to Customer for any cause of action, regardless of the form of any claim or action, will not exceed the fees paid by the Customer to 3Play Media under the Order for the Services which form the subject of the claim, during the six-month period immediately preceding the event giving rise to the claim.

OpenAI

  1. OpenAI.  Some 3Play Media services, such as Audio Description, Summarization, and Dubbing, may include outputs from OpenAI as part of the workflow.  By ordering such services, you are subject to OpenAI terms and conditions, DPA. and Privacy Policy.  
  2. Data Retention; Training.  3Play Media has selected the most restrictive data retention policy and has not granted OpenAI the right to train its models using data it submits on behalf of its customers.
  3. Disclaimers; Assumption of Risk. In addition to the disclaimers set forth in the Agreement, OpenAI outputs, when provided as Stand-Alone AI Features (defined above), are provided “as-is” and without warranty.  In addition, 3Play Media’s liability for damages to Customer for any cause of action, regardless of the form of any claim or action, will not exceed the fees paid by the Customer to 3Play Media under the Order for the Services which form the subject of the claim, during the six-month period immediately preceding the event giving rise to the claim.

Anthropic 

  1. Anthropic.  Some 3Play Media services, such as Audio Description, Dubbing, Subtitling, and Translation, may include outputs from Anthropic as part of the workflow.  By ordering such services, you are subject to Anthropic terms and conditions, DPA, and Privacy Policy.
